Privacy Notice

1. Introduction
1.1 Acast, along with its direct and indirect subsidiaries, is committed to safeguarding your privacy and we always aim to achieve a high level of protection for your personal data. Through this Privacy Notice (the “Notice”) we aim to explain what type of personal data we collect about you through your participation in surveys, questionnaires, feedback forms and similar evaluations (collectively, the "Evaluation"), how we collect and process your personal data and why we collect it.
1.2 By participating in the Evaluation, you do so with the knowledge that your data will be collected and processed as described in this Notice or Acast's GDPR Privacy Policy, available here.
1.3 For the purposes of applicable data privacy laws, including the General Data Protection Regulation 2016/69 (“GDPR”), Acast AB (publ) company reg. no. 556946-8498 with a registered office in Kungsgatan 28, 111 35 Stockholm, Sweden (“Acast”, “we”, “us” or “our”) is the data controller responsible for the processing of your personal data pursuant to this Notice.
2. What personal data do we collect and what is our lawful basis for the processing?
2.1 Whenever you choose to participate in the Evaluation and submit your answers, Acast will collect and process your personal data. This includes, for example:
- Contact details (name, e-mail address, telephone number);
- Age;
- Profile picture;
- Country of residence;
- Social media profiles;
- Personal life data (hobbies, interests, occupation, home ownership status, educational background, etc.); and
- Any other personal data that you choose to give us.
2.2 In addition to the personal data listed above, we may in some cases also collect and process certain categories of sensitive personal data as defined in applicable data privacy laws, including:
- Data revealing your racial or ethnic origin;
- Data revealing your political opinions, religious or philosophical beliefs; and
- Data concerning your sexual orientation or sex life.
Acast would like to make sure that you are fully aware that questions revealing some of your sensitive personal data (as described above) are entirely optional. If you do not wish Acast to collect and process that data, you may skip these questions.
2.3 The processing of your personal data described Section 2.1 is based on our legitimate interest. When balancing interests, we have concluded that the processing will have minimal impact to your privacy and that it is necessary to find the best sponsors or advertising opportunities for you and your content. The processing of your personal data described in Section 2.2 is based on your consent.
3. For which purposes do we process your personal data?
Acast collects and processes your personal data in order to:
- Find better advertising, sponsorship and/or branded content opportunities for your podcast content that are relevant to you and your interests;
- Gain insights into your interests and preferences as a podcast host in order to make stronger connections between you and our advertisers and/or sponsors;
- Create vertical segments based on your demographics data for advertisers and/or sponsors to target specific campaigns based on those demographics;
- Promote your podcast in relevant situations, for e.g. Pride Month;
- For pitching your podcast to current and prospective advertisers and/or sponsors;
- Compile statistics for analytics, marketing and/or reporting purposes;
- To support, monitor and report our DEI efforts; and
- For internal use by the Acast sales and content team.
4. How do we protect your personal data and for how long will it be retained?
4.1 Acast will continuously ensure that we have implemented appropriate technical and organisational measures to protect the security of your personal data. These measures include These measures include routines for pseudonymization and deletion of the data, vulnerability management, and policies for access control and security monitoring. 4.2 Your personal data will be retained for as long as Acast hosts, distributes and monetises your podcast content and for a reasonable period thereafter. You can request deletion of your personal data by emailing us at privacy@acast.com or by deleting your personal data in your host marketplace profile.
5. Will Acast share your personal data with any third parties?
5.1 Your personal data will be securely stored within Acast’s IT systems, including AWS and Google Workspace. While Acast will not share the entirety of your Evaluation responses with our advertisers and/or sponsors, we may share insights regarding you, your podcast content and/or your interests with them.
5.2 We may also share your personal data with other companies in the Acast group (including our subsidiaries) in order to carry out our daily business operations and provide you with the Evaluation as described in this Notice.
5.3 We will share your personal data with a third-party if we are required to do so by law or if we in good faith believe that such action is necessary to comply with a legal obligation under applicable law or a valid legal process.
5.4 Acast shares your data internationally with Acast group companies, subcontractors and partners when carrying out the activities described in this Notice. When transferring your personal data outside the EEA, Switzerland or the UK, we ensure appropriate mechanisms are in place to protect your personal data. This includes entering into a contract with the Acast group companies, subcontractors or partners that incorporate the EU Commission's standard contractual clauses (available at the EU Commission’s website), or ensuring that the international transfer is subject to an EU adequacy decision, such as the EU-US Data Privacy Framework.
6. How can you exercise your privacy rights?
6.1 Acast would like to make sure that you are fully aware of all of your privacy rights. As an individual subject to Acast’s processing of your personal data, you have the following rights:
- Right to withdraw consent: when we process your personal data based on your consent, you can withdraw your consent at any time. The withdrawal of consent shall however not affect the lawfulness of processing based on your consent before its withdrawal;
- Right of access: you can request access to the personal data we collect and process about you;
- Right to rectification: you can request that we update or correct any incomplete or inaccurate personal data concerning you;
- Right to erasure: in certain circumstances, you can request that we delete your personal data that we (i) no longer need for the purpose it was collected for, or (ii) process based on your consent and you withdraw your consent. There are situations where Acast is unable to delete your data, for example when the data is still necessary to process for the purpose for which it was collected, Acast’s interest to continue to process the data overrides your interest in having it deleted, or because we have a legal obligation to keep the data;
- Right to restriction: if you believe that your personal data is inaccurate, that our processing is unlawful, that we no longer need your information for a specific purpose, or if you object to the processing of your personal data, you have the right to request that we temporarily or permanently restrict the processing of some or all of your personal data;
- Right to data portability: when we are processing your personal data on the legal basis of consent or performance of contract, you have the right to request a copy of your personal data in an electronically retrievable form and the right to use that data in other services;
- Right to object: when we are processing your personal data on the legal basis of legitimate interest, you have the right to object to the processing of your personal data on grounds relating to your particular situation. You also have the right to object to the processing of your personal data when we are using it for direct marketing purposes; and
- Right to lodge a complaint: if you believe your personal data is not being processed in accordance with applicable privacy laws, you have the right to lodge a complaint to the competent data protection authority.

7. Update to this Notice
We reserve the right to modify or amend this Notice at any time. When we make material changes to this Notice, we will reasonably notify you of those changes. Any changes to this Notice will become effective as of the date that appears at the very beginning of this document in the section “Last updated on”. Your continued participation in the Evaluation following the posting of changes will be deemed an acceptance of those changes.
